If you haven't already done so, you may want to start with your own insurance company.  They won't be paying out, but they will fight with the other insurance companies on your behalf and cut through all of the BS.  If they don't pay out anything, it won't go against you or raise your rates.  If you were rear ended, it's not your fault.

I had a similar thing happen a few years ago, got the run around from the other insurance companies.  Then, my insurance company, USAA, kicked the asses of the other drivers' insurance companies, and didn't touch my rates.  They paid out in full.

My insurance doesnt have any real obligation to help me on the boat since I didn't have it insured under a separate policy (Captain Hindsight here says that may not have been the best choice).  They can help me with the car portion of stuff though so I need to lean on that more.   No one is pointing fingers at me at this point for blame but they are pointing it at everyone else but their insured.  Its not to the point of needing to lawyer up as there are still a few avenues I can lean on first, but just preparing myself.
