So I went out of Depoe Bay this past Sunday, had a great day (and even better Monday) but was a little creeped out by the drone that came up and hovered about 40 feet over and around me. I couldn't decide between a smile and a wave, or a grand bird flipping.  I went with plan C - turned my back on it and it shortly buzzed off.
Ideas?

I was there Sunday too, but never saw a drone. I can be pretty oblivious though. Lol.
 The whales were cool though.

In a large open area 40' is too close.  Turnabout is fair play. Lob a cast near it if it's bugging you. I'm sure the pilot would back off.

Technically, if it is not directly above you and is operating in a safe manner, the operator is doing nothing wrong. A drone is considered an aircraft and is in the federal airspace as soon as it leaves the ground. If you did something to cause it to crash or damage it, it is a Federal crime and an expensive one at that.  If it was operating in a manner that was reckless, call law enforcement.  Just remember that most are recording a video so there will be a record of whether or not it was "reckless."  Don't file a false report because for some reason you think your privacy is infringed upon when you are in public space with no expectation of privacy.  If the owner is found and the drone is over 250 grams and is not registered with the FAA and marked with the registration number the pilot gets a nice big fine.

I do not mean this to be a lecture, but I just don't want to see someone get into trouble.

It's illegal to harass someone while hunting or fishing.
If a drone was following me around and hovering 40' away, I'd feel I was being harrassed.  Safe or unsafe would depend on the conditions and the pilot.  While this case may have not been illegal, I'd obviously disagree the pilot was, "doing nothing wrong".

Legal or not, hovering 40' away from someone with plenty of room to fly somewhere else is being a jerk.  I want to keep flying and it's this type of behavior that causes the public to be uneasy around drones ultimately leading to more regulation of the sport.
